By accessing or using our website, submitting a form, requesting an inspection, communicating with us, or using any online service offered by The Dock Experts, you agree to these Terms. If you do not agree, please do not use the website.

1. About The Dock Experts

The Dock Experts provides marine construction, dock, seawall, boat lift, piling, retaining wall, concrete repair, maintenance, inspection, and related waterfront property services in Florida. Information on the website is provided for general informational, scheduling, customer service, and business purposes.

The website may refer to inspections, estimates, consultations, maintenance plans, repair services, construction services, permitting assistance, client portals, third-party links, forms, and other offerings. Specific services, pricing, project scope, warranties, payment obligations, schedules, exclusions, and deliverables are governed by the applicable written proposal, estimate, service agreement, maintenance plan agreement, invoice, work order, or contract between you and The Dock Experts.

2. Website Use

You may use the website only for lawful purposes and in accordance with these Terms. You agree not to:

– Use the website in any way that violates applicable law or regulation;
– Interfere with, damage, disrupt, or attempt to gain unauthorized access to the website, servers, systems, accounts, or data;
– Submit false, misleading, incomplete, or inaccurate information;
– Use the website to transmit spam, malware, malicious code, or other harmful materials;
– Scrape, copy, harvest, or misuse website content or data without our written permission;

3. Website Content Is Not Professional Engineering, Legal, or Permitting Advice

Although we strive to provide accurate and helpful information, website content should not be treated as engineering advice, legal advice, permitting advice, a code-compliance determination, a structural certification, or a substitute for a written evaluation by qualified professionals.

Waterfront properties, docks, seawalls, boat lifts, pilings, retaining walls, and marine structures may be affected by property-specific conditions, including tides, soil movement, erosion, storm activity, saltwater exposure, permitting requirements, local ordinances, structural conditions, utility locations, access limitations, and other factors. Any recommendations, estimates, or opinions are subject to site conditions, further inspection, permitting requirements, engineering review when applicable, and a written agreement.

4. Free Inspections, Estimates, and Requests for Service

You may request a free inspection, consultation, estimate, appointment, or other service through the website, by phone, by email, through a client portal, or by other approved communication methods.

Submitting a request does not create a binding contract, guarantee service availability, reserve a specific appointment time, or obligate The Dock Experts to perform work. We may accept, decline, reschedule, or request additional information regarding any request.

Any estimate, quote, proposal, or recommendation is subject to revision based on site conditions, materials, labor availability, access, permitting, engineering requirements, government approvals, hidden conditions, customer changes, weather, supplier pricing, or other factors. A project or service engagement becomes binding only when the applicable written agreement, proposal, estimate, invoice, work order, or contract is approved in accordance with our procedures.

5. Separate Service Agreements Control

These Terms apply to use of the website and general online interactions with The Dock Experts. They do not replace, modify, or supersede any signed written agreement, maintenance plan agreement, repair contract, construction contract, proposal, invoice, work authorization, or other written agreement between you and The Dock Experts.

If there is a conflict between these Terms and a written agreement signed or accepted by both parties for a specific project or service, the project-specific written agreement will control for that project or service.

6. Customer Responsibilities

When requesting inspections, estimates, or services, you agree to provide accurate and complete information, including your name, contact information, property address, project details, access instructions, and any known conditions that may affect the work.

You are responsible for:

– Confirming that you have the authority to request services at the property;
– Providing safe and reasonable access to the property, dock, seawall, boat lift, shoreline, utilities, and work areas;
– Disclosing known hazards, defects, prior damage, structural concerns, access restrictions, property disputes, HOA or association requirements, permitting issues, utility locations, environmental concerns, or other relevant conditions;
– Securing pets, vessels, personal property, gates, access points, and areas that may interfere with inspection or work;
– Obtaining approvals, signatures, or permissions from owners, associations, tenants, neighbors, government authorities, or other parties when required, unless a written agreement expressly states otherwise.

The Dock Experts is not responsible for delays, additional costs, denied access, inaccurate information, undisclosed conditions, or inability to perform work caused by your failure to satisfy these responsibilities.

7. Permits, Ordinances, and Government Approvals

Marine construction and waterfront work may require permits, inspections, engineering, association approvals, environmental approvals, municipal approvals, county approvals, state approvals, federal approvals, or compliance with local ordinances and regulations.

When agreed in writing, The Dock Experts may assist with permitting, paperwork, and compliance coordination. However, unless expressly stated in a written agreement, we do not guarantee that any permit, approval, variance, inspection approval, or governmental authorization will be granted, or that it will be granted within a specific timeframe.

Governmental or third-party review timelines, agency decisions, permitting requirements, plan revisions, engineering requirements, environmental conditions, and code interpretations are outside our sole control.

8. Scheduling, Weather, Site Conditions, and Delays

Scheduled appointments and project timelines are estimates and may change due to weather, tides, storms, site access, permitting, inspections, labor availability, material availability, customer delays, unsafe conditions, emergencies, supplier issues, governmental delays, force majeure events, or other circumstances beyond our reasonable control.

The Dock Experts may reschedule inspections, appointments, deliveries, or work when conditions are unsafe, access is unavailable, required approvals are missing, payment obligations have not been satisfied, materials are delayed, or other reasonable circumstances require rescheduling.

9. Payments, Deposits, Invoices, and Collections

Fees, deposits, payment schedules, progress payments, final payments, financing terms, change orders, and other payment obligations will be stated in the applicable estimate, proposal, invoice, service agreement, maintenance plan agreement, work order, or contract.

You agree to pay all amounts owed in accordance with the applicable written agreement or invoice. Unless otherwise stated in writing, amounts due must be paid when due and are not contingent upon financing, insurance reimbursement, sale of property, third-party reimbursement, or other external events.

If payment is not made when due, The Dock Experts may suspend services, delay scheduling, withhold deliverables, decline additional work, pursue collection, recover costs of collection, and exercise any rights available under the applicable agreement or law.

10. Change Orders and Additional Work

Any work outside the agreed scope may require a separate written agreement, revised estimate, change order, invoice, or written approval. Additional work may include, without limitation, repairs discovered during inspection or construction, hidden damage, structural deficiencies, changed site conditions, code or permit requirements, customer-requested changes, material upgrades, access improvements, emergency stabilization, or work recommended in an inspection report.

The Dock Experts is not obligated to perform additional work unless it is approved in writing and payment terms are agreed upon.

11. Maintenance Plans

Maintenance plans, annual service plans, seawall maintenance agreements, dock maintenance agreements, boat lift maintenance agreements, and related recurring services are subject to their applicable plan documents and written terms.

Unless otherwise stated in a specific maintenance plan agreement, maintenance services are limited to the services expressly included in the plan. Repairs, replacement parts, structural work, upgrades, emergency service, code compliance work, and additional labor are not included unless expressly stated in writing.

12. Inspection Reports and Recommendations

Inspection reports, photographs, videos, comments, and recommendations are based on visible and reasonably accessible conditions at the time of inspection, unless otherwise stated in writing. They are not guarantees of current or future performance, structural adequacy, code compliance, life expectancy, or fitness for a particular purpose.

Conditions may change after an inspection due to weather, tides, storms, vessel impact, use, age, corrosion, erosion, soil movement, hidden defects, or other factors. Recommendations are general in nature unless a signed engineering report or specific written professional evaluation states otherwise.

13. Online Store, Client Portal, and Third-Party Services

The website may include links to or references to a client portal, online store, payment processor, financing provider, career site, social media platform, review site, map provider, scheduling tool, or other third-party service.

Third-party services are operated by independent providers and may be subject to their own terms, privacy policies, fees, and practices. The Dock Experts is not responsible for third-party websites, services, content, payment processing platforms, availability, security, or policies.

If an online store is available, product availability, pricing, taxes, shipping, pickup, delivery, returns, warranties, and other product-specific terms may be stated at checkout or in separate purchase terms.

The website, including text, images, photographs, videos, logos, graphics, designs, page layouts, service descriptions, articles, and other content, is owned by or licensed to The Dock Experts and is protected by intellectual property laws.

Public use of customer testimonials, project photos, or identifying customer information will be handled in accordance with applicable law and our Privacy Policy.

How You Opt In

You may opt in to receive text messages from The Dock Experts by checking an SMS consent checkbox on our website forms, submitting a form that includes SMS consent language, providing consent during scheduling or customer service communications, signing a written or electronic consent form, or otherwise providing your express consent to receive text messages from The Dock Experts.

By opting in, you represent that you are the account holder or customary user of the mobile telephone number provided and that you are authorized to consent to receive text messages at that number.

Opt-Out Instructions

Consent Is Not a Condition of Purchase

To the fullest extent permitted by law, The Dock Experts’ total liability arising from or related to website use will not exceed one hundred dollars ($100) or the amount you paid directly to The Dock Experts for the specific online service giving rise to the claim, whichever is greater.

This limitation does not limit liability that cannot be limited under applicable law and does not replace any liability terms in a signed written agreement for a specific project or service.

You agree to defend, indemnify, and hold harmless The Dock Experts, its owners, officers, employees, contractors, affiliates, vendors, and agents from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:

25. Class Action Waiver

To the fullest extent permitted by law, any claim, dispute, or controversy arising from or related to these Terms, the website, or your use of the website must be brought only in your individual capacity and not as a plaintiff, class member, or representative in any class action, collective action, representative action, consolidated action, private attorney general action, or similar proceeding.
